Impact of the Import Control System 2 (ICS2) on EU Customs and Trade

The Import Control System 2 (ICS2) signifies a monumental leap forward in customs security processes for the European Union (EU) and its associated territories. This automated entry system, inaugurated on June 3, 2024, is poised to safeguard the EU's single market and its populace by fortifying border security measures.
What exactly is ICS2, and how does it operate?
At its core, ICS2 is an IT framework meticulously engineered to gather comprehensive data regarding all incoming cargo destined for the EU. Its fundamental objective revolves around bolstering security protocols at the EU's external borders. Here are some pivotal aspects of ICS2:
  • Data Collection: ICS2 meticulously gathers a wealth of information pertaining to incoming cargo, encompassing details about the goods themselves, the modes of transportation employed (including sea, inland waterways, road, and rail), and the various economic entities involved in the shipment process.
  • Security Measures: Leveraging the collected data, ICS2 meticulously scrutinizes for potential risks, thereby ensuring the implementation of requisite security measures. Its functionality is pivotal in thwarting illicit activities such as smuggling, terrorism, and trafficking.
  • Economic Operators’ Obligations: Economic entities, spanning carriers, logistics providers, and final consignees, are mandated to furnish a comprehensive Entry Summary Declaration (ENS) dataset to ICS2. Even postal and express carriers are encompassed within this obligation framework.
The implementation of ICS2 unfolds across various stages to facilitate a seamless transition:
  • Connectivity Testing (Commenced on July 1, 2023): Economic operators undertook mandatory connectivity testing to ascertain the seamless integration of their systems with ICS2.
  • Functional Testing (Conducted by December 11, 2023): Operators verified the alignment of their operational processes with the stipulated requirements of ICS2.
  • Release 3 Go-Live (June 3, 2024): Maritime and inland waterways carriers initiated the utilization of ICS2. House level filers joined the fray on December 4, 2024, followed by road and rail carriers on April 1, 2025.
Preparation for ICS2 mandates a series of proactive measures on the part of economic operators:
  • IT System Updates: Entities are required to upgrade their IT infrastructure to seamlessly accommodate the requisites of ICS2.
  • Staff Training: Adequate training regimens ensure the comprehension of the novel processes associated with ICS2.
  • Self-Conformance Testing: Mandatory self-conformance tests are to be conducted before commencing operations to ensure compliance.
The ramifications of ICS2 transcend beyond the realm of customs security:
  • Trade Facilitation: By expediting cargo processing, ICS2 serves as a catalyst for streamlined cross-border movements, thereby fostering the facilitation of free trade.
  • Risk Management: Early identification of potential threats within the supply chain augments risk management endeavors, thereby fortifying supply chain security.
  • Global Business Models: ICS2 exhibits adaptability to global business models, thereby simplifying compliance with EU regulations for international trade partners.
In summation, ICS2 stands as an emblem of substantial progress in both customs security and trade efficiency within the EU. As the EU continues to fortify its security apparatus, ICS2 occupies a pivotal role in safeguarding the interests of commerce and citizenry alike.

Practical issues in RoDTEP Scheme

I hope, by now, everybody is aware of what is the RoDTEP Scheme. Assuming that let me highlight some practical questions regarding this scheme. On 28th October 2020 under the chair of Mr. G. K. Pillai, the RoDTEP Committee was formed. The main objective of this committee is to determine the ceiling rates of items covered under the scheme. However, the data of chapter 86, 88, and 89 are still pending from the industry's side. It is predicted that the Remission of Duties and Taxes on Exported Products briefly known as the RoDTEP Scheme is likely to be launched under the new Foreign Trade Policy. The scheme seeks to refund currently un-refunded duties/taxes/levies at the local, state, and central level have borne on the exported products. In view of the above, I have jotted down some key questions which need to be answered, 1.  How to segregate the VAT and Excise Duty leviable on petrol & diesel on export and domestic selling products? 2.  How to segregate the electricity duty bet

Drafting Transfer Pricing Legislation: Taxes Covered

Depending on the design of a country’s tax system, application of the arm’s-length principle may be relevant in determining the taxable objects for one or more direct taxes (income tax, corporate tax, profits tax, etc.). Generally, most countries’ transfer pricing legislation has broad application across direct taxes. One notable exception being Ireland, where the transfer pricing legislation introduced in 2010 applies only to certain classes of income for direct tax purposes.  Countries with other specific types of direct taxes governing specific sectors or transactions types (such as a mining income tax) may need to consider application of transfer pricing legislation to them. Typically, this would be achieved through separate provisions being inserted in the relevant taxing acts. However, where a consolidated tax code has been adopted, a single set of legislation may be possible. Transfer pricing provisions may also be necessary for other types of taxes such as a resources royalty p

Government’s Push: Boosting India’s Plastic Exports via SEZs

Overview The Indian government has been pushing to boost the country's plastic exports through Special Economic Zones (SEZs) and incentives. The SEZ scheme was introduced in India on April 1, 2000, to enhance foreign investment and provide an internationally competitive and hassle-free environment for exports. The SEZ policy has been successful in promoting private investment in industrial activity, infrastructure investment, employment, and exports since its introduction. According to the Ministry of Commerce and Industry, SEZ exports increased by 3.3% between 2005-06 and 2020-21, from INR228.40 billion to INR7595.24 billion, and investment in SEZs increased by 15.3% during the same period, from INR40.355 billion to INR6174.99 billion. The government's push to boost India's plastic exports via SEZs and incentives is expected to further increase the country's exports and attract foreign investment. The SEZs offer incentives to resident businesses, such as competitiv
